Chat Room Use:
As a user of the Cybertown Chat Room ("User"), you are responsible for your own communications and are responsible for the consequences of posting those communications, or any other information or materials (collectively, the "Communications")
Cybertown does not represent or guarantee the truthfulness, accuracy, or reliability of any Communications posted by Chat Room Users or endorse any opinions expressed by Users. User acknowledges that any reliance on Communications posted by other Users will be at User's own risk.
Cybertown does not screen Communications in advance and is not responsible for screening or monitoring material posted by Users. If notified by a User of Communications which allegedly do not conform to the terms and conditions set forth in these Legal Notices, Cybertown may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the Communication. Cybertown has no liability or responsibility to Users for performance or nonperformance of such activities, or for any acts or omissions of other Users.
While we strive to be a family-friendly site, since we have so many members creating images and 3D objects, it is not possible to control them all and occasionally some slip through that some might not consider suitable for children so we recommend parental guidance. If you come across any images or objects that you consider unsuitable for children, please report them to Cybertown Security.
Cybertown reserves the right to expel Users and prevent their further access to the Chat Room for violating the terms and conditions set forth in these Legal Notices or the law and the right to remove Communications which are abusive, illegal, or disruptive as well as for unlawful acts which may be perpetrated by Cybertown users acting unlawfully outside of Cybertown.
In consideration of being allowed to use the Chat Room facilities provided by Cybertown, you agree that you will not:
a. Use the Chat Room facilities for any purpose in violation of local, state, or national laws of any country.
b. Post material that is copyrighted, unless User is the copyright owner or has the permission of the copyright owner to post it.
c. Post material that reveals trade secrets, unless User owns them or has the permission of the copyright owner.
d. Post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others.
e. Post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another User or any other person or entity.
f. Post sexually-explicit images.
g. Post advertisements or solicitations of business.
h. Disrupt the normal flow of dialogue, or post comments that are not related to the topic being discussed (unless it is clear that the discussion is freeform).
i. Post chain letters or pyramid schemes.
j. Impersonate another person.
k. Attempt to make any unauthorized changes to the site or its operations (hacking).
User Submissions:
Communications you transmit or post to or make available for use at this Site shall be deemed to be provided on a nonproprietary and non-confidential basis. Cybertown shall have no obligation of any kind with respect to such Communications and shall be free to use or disseminate such Communications on an unrestricted basis for any purpose.
By posting or making available Communications of any kind, you grant: (a) to Cybertown a royalty-free, perpetual, irrevocable nonexclusive license to use, reproduce, modify, publish, translate, distribute, perform and display those Communications alone or as part of other works in any form, media, or technology whether now known or hereafter developed and sublicense such rights through multiple tiers of sublicenses; (b) to other Users the right to access, view, store, and reproduce the Communications for personal use.
You acknowledge that you are solely responsible for the Communications that you submit and bear full and exclusive responsibility for the legality, reliability and appropriateness of the Communications.
Where you upload or provide 3D virtual objects of any kind including homes that you created into the virtual shopping mall or any part of Cybertown, or images that you created to anywhere in Cybertown, these will remain your property. You are giving Cybertown the right, without time limit, of use and of distribution to other members of this community. Cybertown does not grant the right to demand removal of objects, homes, texts or images already distributed.
Virtual Jobs:
The Site incorporates a virtual social structure with volunteer-staffed roles, and many of the members choose to accept volunteer roles. If you accept a role or roles within the social structure of the Site you understand that this does not constitute an employment agreement with either Cybertown or blaxxun or with any other entity and that you have chosen to participate without the intention or expectation of fiduciary compensation of any kind, but rather to pursue personal interests and to more fully enjoy participation in the multiple community and leadership aspects of the Site. You also understand that in accepting any volunteer roles you do not in any way represent Cybertown, blaxxun or its officers.
Indemnity:
You agree to defend, indemnify, and hold harmless Cybertown, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, resulting or allegedly resulting from your use of this Site or your breach of the terms and conditions set forth in these Legal Notices.

The linked sites are not under the control of Cybertown and Cybertown is not responsible for the content of any linked site or any link contained in a linked site, or any changes or updates to such sites. Cybertown reserves the right to terminate any link or linking program at any time. Cybertown is providing these links to you only as a convenience. Cybertown does not endorse companies or products to which it links and reserves the right to note as such on its web pages. If you decide to access any of the third party sites linked to this Site, you do this entirely at your own risk. Further, other sites may contain links to this Site. Termination of Members
At all times and regardless of any situation, Cybertown management reserves the right to refuse membership to anyone. From time to time Cybertown terminates the participation rights of members either temporarily or permanently. Specific reasons for termination vary and can include but are not limited to false or misleading statements or actions, creating any accounts in an effort to defraud the subscription agreement, stated or actual attempts to interfere with the operation of the community, other unlawful acts or omissions, or violations of the Constitution, Legal Notices or other documents posted within the Cybertown website.
Any such termination shall be at Cybertown's sole discretion and may occur without prior notice, or any notice or explanation. Cybertown further reserves the right to terminate any user's access to Cybertown or to any of the products and services including any e-mail accounts, homes, clubs and objects for any conduct that Cybertown, in its sole discretion, believes is or may be directly or indirectly harmful to other users, to Cybertown or its subsidiaries, affiliates, or business contractors, or to other third parties, or for any conduct that violates any local, state, federal, or foreign laws or regulations. Cybertown further reserves the right to terminate any user's access to Cybertown or to any of the products and services for any reason or for no reason at all, in Cybertown's sole discretion, without prior notice, or any notice. If participants return to Cybertown in violation of their termination, then Cybertown can and does pursue legal remedies. When a member is so terminated, Cybertown may at its discretion issue a single statement detailing the factual reasons for the termination but will not discuss it further.
